Guaranteed Highest Price Program Rules & Regulations
The terms and conditions of the Guaranteed Highest Price Program are as follow:
The Seller(s) must maintain the exclusive listing agreement with Roger Jarnigan Homes Collection, Inc. until the sale of the home closes
The Seller(s) MUST permit the Listing Agent, Roger Jarnigan, to authorize and control all the marketing involved in the listing of the property, this includes but is not limited to staging (if applicable), photographs, ad campaigns, list price of the property, etc.
The List Price shall be based on the median price of the most recent and comparable Active properties as selected by the Listing Agent from the MLS. The Listing Agent reserves the right to consider or reject any price request of the Seller(s) that is above the average and median price of the comparable properties. Ultimately the list price of the property shall be any mutually agreed upon price between Listing Agent and Seller(s).
List Prices shall be adjusted per agreement as follows:
Days active on the market 1 - 14 $________
Days active on the market 15 - 30 $________
Days active on the market 30+ $________
For the purposes of any “reimbursement” in the case that the program fails in delivering an offer equal or greater than 98% of the list price, the home must have been sold with Roger Jarnigan, without obtaining an offer equal to or greater than 98% of the list price.
The Listing Agent will recommend and advise on properly preparing the house for staging and photographs. The Seller(s) shall keep the home in “Showing” condition for all showings as recommended by the Listing Agent.
Seller(s) shall vacate the home along with any pets (or placed in a confined area) prior to and during the entire duration of all showings and shall only return to the home after the showing is finished and all parties have exited the property.
Seller(s) shall make the house available for all showings requested, which will be Monday through Sunday and between the hours of 10:00 a.m and 7:00 p.m. Unless other arrangements have been made.
Seller(s) shall permit a lockbox on the property in order to accommodate all showings.
If the Listing Agent receives notification from any other agent, broker, prospective buyer(s) that any of the above conditions were not met as described and agreed upon, the Seller(s) participation in this program can be terminated and the Listing Agent would be released from all and any responsibilities from this program. The listing agreement will remain in effect minus the “program”.
Terms of Guarantee: If Seller(s) does not receive an offer for at least 98% of list price, the Listing Agent will provide to Seller(s) a reduction in commission according to the scale in item #12 below.
Cash Guarantee (if program fails to deliver) shall be paid on the following scale, according to the final Gross selling price: Homes $4M+ - $15K Cash Guarantee
Homes $3M-$3,999,999 - $12K Cash Guarantee
Homes $2M-$2,999,999 - $10K Cash Guarantee
Homes $1M-$1,999,999 - $5K Cash Guarantee
Homes $500k-$999,999 - $2,5K Cash Guarantee
Cash Guarantee (if any) shall be offered to the Seller(s) at the time of closing in the form of a commission reduction.
If at any time, Seller receives an offer equal to or greater than 98% of List Price, broker/agents obligations will be deemed to have been met and broker/agent shall not be obligated to provide any commission discount at closing. Broker/agent obligations will further be deemed to have been met and broker/agent will not provide any commission discount in the event that the Seller(s) rejects the offer equal to or greater than 98% of List Price or the Buyer(s) should cancel their contract for any reasons.
The Seller(s) shall pay Equity Union Real Estate a commission equal to 3% of the final selling price.
If Seller(s) is in violation of any of the terms herein, e.g. broker/agent receives notification that home was not available or not in “show” condition, or not vacated by Seller(s) at time of showing, the terms of this agreement shall become null and void and broker/agent will have no obligation to pay any commission reduction to Seller(s) at closing. Broker/agent shall be immediately released of any and all responsibilities for anything related to this program.
